1. About 360SOFTY

360SOFTY is operated by 360SOFTY LTD in the United Kingdom and 360SOFTY PVT LTD in Sri Lanka.

We provide software development, SaaS MVP development, web applications, mobile applications, AI automation, cloud infrastructure, DevOps, legacy modernisation, support, and related technology services.

2. Website Use

You may use this website for lawful purposes only.

You must not:

  • misuse, attack, scan, scrape, or disrupt the website;
  • attempt unauthorised access to our systems;
  • copy our content, branding, designs, or materials without permission;
  • submit false, misleading, harmful, or unlawful information through our forms.

Any pricing, timeline, or estimate shared by 360SOFTY is based on the information available at the time.

Estimates may change if:

  • requirements change;
  • the project scope expands;
  • third-party services are required;
  • technical risks are discovered;
  • integrations, security, infrastructure, or compliance requirements change.

We are not responsible for delays caused by incomplete client feedback, missing content, unavailable third-party systems, delayed approvals, or changes in scope.

6. Client Responsibilities

Clients are responsible for:

  • providing accurate requirements;
  • giving timely feedback and approvals;
  • supplying required content, credentials, data, access, and business information;
  • ensuring they have rights to any materials provided to us;
  • reviewing deliverables before approval or launch;
  • complying with laws applicable to their business and users.

7. Intellectual Property

Unless agreed otherwise in writing:

  • 360SOFTY retains ownership of its pre-existing code, frameworks, templates, tools, processes, know-how, documentation, and reusable components;
  • the client owns custom project deliverables after full payment has been received;
  • third-party libraries, platforms, APIs, fonts, software, and services remain subject to their own licences and terms.

We may reuse general technical knowledge, architecture patterns, development methods, and non-confidential learnings across projects.

8. Portfolio and Case Studies

Unless restricted by written agreement, we may mention completed work, project type, industry, technology stack, and non-confidential outcomes in our portfolio, website, proposals, or marketing material.

We will not publish confidential business information without permission.

9. Third-Party Services

Projects may use third-party services such as hosting providers, cloud platforms, payment gateways, AI APIs, analytics tools, communication tools, email services, maps, authentication providers, and other integrations.

360SOFTY is not responsible for failures, pricing changes, downtime, data loss, policy changes, or service limitations caused by third-party providers.

10. AI and Automation Services

Where we build or integrate AI features, results may not always be perfect, complete, accurate, or suitable for every use case.

Clients are responsible for reviewing AI-generated outputs before using them in business, legal, financial, medical, public, or customer-facing contexts.

360SOFTY does not guarantee that AI systems will always produce error-free, unbiased, or compliant results.

11. Payments

Payment terms will be defined in the applicable quotation, invoice, proposal, or agreement.

Unless otherwise agreed, work may be paused if payments are overdue.

Payments already made may be non-refundable once work has started, resources have been allocated, or deliverables have been provided.

12. Support and Maintenance

Support, maintenance, monitoring, bug fixing, hosting management, and optimisation are only included if agreed in writing.

After project delivery, new features, changes, improvements, third-party updates, security patches, or infrastructure work may be charged separately unless covered by an active maintenance agreement.

13. Confidentiality

Both parties may receive confidential information during discussions or projects.

Confidential information must not be disclosed to third parties unless required for project delivery, authorised by the other party, or required by law.

14. Limitation of Liability

To the maximum extent permitted by law, 360SOFTY is not liable for:

  • indirect, incidental, or consequential losses;
  • loss of profits, revenue, business, data, goodwill, or opportunity;
  • issues caused by third-party platforms or services;
  • security incidents caused by client-side misconfiguration, weak credentials, delayed updates, or unauthorised access outside our control.

Our total liability for any claim is limited to the amount paid by the client for the relevant service giving rise to the claim, unless the law requires otherwise.

15. No Guarantee of Business Results

We aim to build reliable, production-ready software.

However, we do not guarantee business outcomes such as revenue, user growth, funding, traffic, search rankings, app downloads, conversions, or profitability.

16. Website Availability

We may update, suspend, change, or remove parts of the website at any time.

We do not guarantee uninterrupted website availability.

18. Termination of Services

Either party may terminate a project or service according to the relevant agreement.

If no written agreement exists, we may stop providing services if:

  • payment is overdue;
  • the client misuses our services;
  • the client requests unlawful or unethical work;
  • cooperation becomes commercially or operationally unreasonable.

19. Governing Law

For services contracted with 360SOFTY LTD, these Terms are governed by the laws of England and Wales.

For services contracted with 360SOFTY PVT LTD, these Terms are governed by the laws of Sri Lanka.

The applicable contracting entity will be determined by the proposal, invoice, agreement, or commercial arrangement.

20. Changes to These Terms

We may update these Terms from time to time.

The updated version will be published on this website with a revised “Last updated” date.
